He told the court in his plea for bail at the Alexander Magistrate’s Court that he should be granted bail becaue he didn’t commit any crime before. He was just stealing Kirsten’s clothes and not the murder. He told,
“On that day, the crime that I committed was talking her clothes. I have never committed crimes before. When the police came to me and ask me, I did not deny it. I did say that I took the clothes. When they asked me to open my phone, I did. I did not resist anything. They searched my room and I complied with everything because I know that I did not commit the crime. The only crime that I will agree to is that I did take the clothes and throw them away.”

Kirsten Klutys was the teacher at Delta Park High School in Blairgowrie. She was found dead on one of the paths near the Sandton Sports Club. It is said that she was murdered during a MyRun event in October.
On 18 December 2023, Bafana thanked the family members and former schoolmates for the support they showed him.

At the court, Bafana Mahungela said that he took her clothes because he thought his fingerprints were on them. However, the state is opposing Bahana’s release on bail.
