A convicted rapist replied ‘lol, sorry bro’ after he was confronted by the on-off romantic partner of his victim just hours after the sexual assault.
Fabian Boroumand, 45, was sentenced to three years and six months behind bars with a non-parole period of 18 months on Tuesday.
He was convicted of sexual intercourse without consent in November 2024 in NSW’s District Court over the offence on the evening of March 12, 2023.
Boroumand raped his friend’s on-off partner following a night of drinking at her apartment in Sydney’s inner west, the Sydney Morning Herald reports.
The court heard the friend messaged Boroumand on Facebook the day after the assault and asked: ‘Something along the lines of “did you have sex with her or put your fingers inside her?”‘
The man told the court he had received a response from Boroumand, adding: ‘Yeah. I got a response something like “lol, sorry bro”.’
The court heard the woman invited her friend, who she had known for 10 years, over to her place around 7pm on March 11, 2023.
She picked him and two of his friends up from a hotel and took them to her apartment where two of her friends joined for an evening of drinking.

The prosecution alleged the victim and her intoxicated on-off partner went to bed together at the end of the night.
But when the friend allegedly left the bed at some stage of the night, Boroumand got into the victim’s bed and digitally penetrated her.
The woman thought Boroumand was her friend at first and went along with the act before turning over and realising she was mistaken.
The court heard that when she realised Boroumand had penetrated her she shouted at him to ‘get out’ and ran down the hallway to wake up her friend.
During cross-examination, the friend told the court: ‘She was pretty distressed, shaking me and telling me to wake up… It had to be like 5am, I slept right through and then I woke up to her yelling and screaming, crying.
‘Like, it took me a little while to get what was going on.’
The friend said Boroumand and the third man had left the apartment at this point and he consoled the woman before suggesting she go to the police.
The woman reported the assault to police the following day, on March 13.

But the woman’s friend rejected this, saying: ‘I know I didn’t do that’.
Boroumand was arrested and granted conditional bail on April 6, 2023. He was ordered not to contact the victim and report to police three times a week.
