Sydney swim coach Kyle Daniels will not face a third trial on allegations of child sexual abuse.

A court was told today the NSW Director of Public Prosecutions had directed there be no further legal proceedings against Daniels, who will now fight for costs.

“Mr Daniels has always maintained his innocence of all charges in respect of these matters,” his lawyer Urania Zafiris said in a statement.

“The jury verdicts and decision to discontinue are entirely appropriate outcomes consistent with that innocence.”

Daniels, who denies intentionally touching any student inappropriately during lessons at a Mosman pool in 2018 and 2019, had been acquitted of 10 sexual abuse charges, including five alleging sexual assault.

The allegations related to nine female students aged six to 10.

But, saying it had applied all efforts and judicial directions to persevere, the 11-person jury remained split on 11 sexual touching and indecent assault charges.

Judge Kara Shead, the Crown and Daniels’ barrister Les Nicholls all agreed the only option was dismissing the jury.
