The criminal case against the mother of a star Brisbane Broncos player facing manslaughter charges over a horror crash that killed three people remains in ‘limbo’ as she waits for further psychiatric testing.

Uiatu ‘Joan’ Taufua – the mother of Broncos forward Payne Haas – was the sole survivor of a two-car collision in Bonogin in the Gold Coast hinterland on December 30, 2022, that left three people dead.

Susan Zimmer, 70, her partner Chris Fawcett, 79, and Ms Zimmer’s 35-year-old daughter Steffanie were travelling in the second car, a silver Mercedes, and each died at the scene.

The 48-year-old woman has also been charged with one count each of dangerous operation of a motor vehicle, evading police and driving without a licence.

She was later charged with mid-range drink-driving in March last year.

Ms Taufua’s matter was briefly mentioned before Southport Magistrates Court on Thursday.

The court was told her Sydney legal team, Kings Law Group, had organised a psychiatric assessment in March to determine whether Ms Taufua should be referred to the mental health court.

However, the Kings Law Group’s town agent said the appointed psychiatrist was going to ‘require a further assessment’ of Ms Taufua and ‘some consult’ with her family about her mental capacity,

Hearing no date had been set for these further consults, magistrate Kerry McGee interjected by stating ‘no, no, no’.

Ms McGee said the case had been dragging on for too long and she needed to know the next consult date.

‘I’m not waiting for it, this has been going on for far too long and these charges need to progress, and they’re not progressing that way,’ she said.

The court was told the report delay was down to the appointed psychiatrist going on leave after his first consult with Ms Taufua.

Ms McGee said there had been sufficient time for the reports to be done after the medical assessment had been ordered in October last year.

‘This has been adjourned for that purpose since October last year, and that’s completely unacceptable,’ she said.

‘I’m assuming she’s got capacity (and) unless there’s evidence to the contrary, I’ll proceed accordingly.

‘This matter has been in limbo for far too long.’

Ms McGee ordered the matter be adjourned to July 11 to allow the reports to be finalised and Kings Law Group make any required applications it needs for the case to progress.

Police allegedly pursued her black 2017 Mercedes wagon before they called off their pursuit after she allegedly fled the area.

Moments later, those same police officers were notified of a crash involving two cars about a kilometre down the road.

Emergency services were able to free the family of three from their silver Mercedes, but they each died at the scene.

Ms Taufua was pulled free from her black Mercedes after it had caught fire.

It will be further alleged in court that Ms Taufua was driving under the influence at the time of the crash.

She was taken to hospital but was later arrested by police.

Ms Taufua did not appear before Southport Magistrates Court on Tuesday, as she remains in on remand at Brisbane Women’s Correctional Centre.

She is yet to enter any formal pleas.

There is no suggestion Mr Haas was involved in the crash.
