Expert: Daniel Penny Didn’t Kill Jordan Neely

Thank God.

You’ll remember what happened Friday, with the manslaughter charge dismissed – a questionable legal decision no one had ever seen before – followed by much-anguished trepidation about a ‘coerced’ verdict. as well as fervent hopes whoever had hung the jury on those charges would have the strength to do the right thing on the negligent homicide deliberations.

…But that is exactly what happens, and the defense, quite rightfully, is losing their minds.

 A judge granted the prosecution’s motion to dismiss the more serious charge of second-degree manslaughter against Daniel Penny on Friday in his trial over the chokehold death of Jordan Neely on a New York City subway last year, clearing the way for the jury to consider the remaining lesser charge of criminally negligent homicide.

…Over defense objections, Judge Maxwell Wiley agreed with prosecutors who argued that dismissing the first count of second-degree manslaughter eliminates the defense’s concern about a compromise verdict.

It sure looks as if they all had the intestinal fortitude to do the right thing by this hero.

A Manhattan jury has cleared Daniel Penny of criminal wrongdoing in the chokehold death of Jordan Neely on a crowded subway — a caught-on-video killing that sparked fierce debate over the city’s mental health system and crime underground.

The panelists acquitted Penny of criminally negligent homicide — which could have put him behind bars for up to four years — in Neely’s chokehold death aboard a crowded uptown F train in May 2023.

…Jurors sided with Penny’s defense attorneys, who had argued that the Marine veteran was justified in rushing to protect his fellow subway straphangers when he subdued the erratic homeless man. The lawyers had also questioned whether there was sufficient evidence that the chokehold caused Neely’s death.





The jury came back quickly this morning.

Jordan Neely’s father had to be escorted from the courtroom because of their outbursts, and there are already protests at the courthouse.

What remains to be seen is the form they take as word of the verdict spreads.

Does the Neely family – and their lawyers – and BLM feed the anger, as they’ve been trying to do all of last week?

Does Mayor Adams jump in here and cool things down as quickly as he can?

And what about Alvin Bragg and his radical ADA Dafna Yoran? Are they fanning fires after this loss or saying “a jury of his peers has spoken”?





Will they be sanctioned? Will they be federally investigated for violating Penny’s civil rights for protecting fellow citizens while ‘white’?

There are a lot of questions right now.

First and foremost, thank you to a NYC jury for doing the right thing in the middle of all this, which has been very wrong.

That was true courage.

God bless them, and God bless Daniel Penny.

May the good Lord keep them all safe.

They are all going to need it.
