The court heard the woman allegedly fell from the passenger side of a Honda sedan as it travelled at 100km/h on the Princes Freeway in Little River on Sunday.

The police summary alleges Fosita admitted “he cracked it” and lost his temper at his sister before he started smashing the radio in the car three to four times.

Magistrate Charlie Rozencwajg stated in court today that his sister “wanted him to stop the car and get out of the car”.

“If it turns out she jumped out of the car, that can only be an indication of how fearful and anxious she was about the accused,” Rozencwajg said.

The Tarneit man has not been charged over the incident but was arrested at the scene for outstanding matters including alleged criminal damage after an argument at the woman’s home.

Two new drug possession charges were laid this morning.

The woman remains in an induced coma at The Alfred hospital with severe swelling on the brain.

The magistrate refused her brother’s application for bail and ordered a psychologist’s report.
