A 50-year-old man in Indiana has been arrested after he was allegedly caught on camera sexually assaulting a woman inside of her own home — even going so far as to tell the victim’s Alexa to turn off the lights during the attack.
David Wagner was taken into custody last week and charged with two counts of rape when the victim has verbally or otherwise refused, one count of sexual battery where the victim is compelled to submit by force or imminent threat, and one count of battery resulting in bodily injury, court records reviewed by Law&Crime show.
According to a probable cause affidavit obtained by the Daily Journal, officers with the Indiana Metropolitan Police Department on Friday, Oct. 13 responded to a caller reporting that she had been raped in her home.
Upon arriving at the scene, police reportedly encountered the female victim who told them she had been sexually assaulted by Wagner. The victim said she had invited Wagner to her home for dinner on the night of Oct. 11 so the two of them could get to know each other.
When Wagner first arrived, the victim said he tried to kiss her and she turned him down, per the Journal. Later in the night, he allegedly asked the victim to touch his genitals and she again refused. The victim reportedly said she invited Wagner to spend the night with the understanding that they would both keep their clothes on and not have sex.
Wagner allegedly continued expressing his desire to have sexual relations with the victim before he allegedly grabbed her by the throat and prevented her from breathing, then threw her on the couch and forcibly removed her clothing. Wagner then allegedly performed sexual acts on the victim without her consent and as she repeatedly told him to stop.

According to a report from Indianapolis Fox affiliate WXIN, investigators learned that the victim’s Ring doorbell camera captured some of the alleged attack on film. The footage allegedly showed Wagner throwing the victim onto her living room couch, Wagner removing her pants as she repeatedly yelled “No,” and Wagner telling the victim’s Alexa to “turn the living room lights out.”
Per the report, the footage concluded with Wagner apologizing to the victim and then leaving her home through the front door as she yelled and cursed at him for attacking her.
The Journal reported that the victim told two people about Wagner attacking and sexually assaulting her. One of those people allegedly told the victim that they spoke to Wagner about what happened and he said that he had made a mistake and was going to turn himself in to authorities.
Court records show that Wagner was taken into custody on Dec. 15 and booked into the Marion County Jail. He was released after posting a $15,000 cash bond on Dec. 18 on the condition that he wear a GPS ankle monitor and have no contact with the alleged victim in the case.
Wagner is currently scheduled to appear in court again for a pretrial conference on Feb. 21.
