‘Morally and intellectually bankrupt’: Lawyer for exonerated man kept in prison slams last-minute order by Missouri Supreme Court

The Missouri Supreme Court blocked the release of a wrongfully-convicted man Wednesday, issuing a last-minute order for him to stay incarcerated just as the man was exiting the prison facility and waiting for a ride.

Christopher Dunn, 52, has served 34 years behind bars for the 1990 murder of 15-year-old Ricco Rogers. However, the evidence used to convict Dunn was primarily the testimony of two child witnesses who later recanted. St. Louis Judge Jason Sengheiser held a two-day hearing in June after which he ruled that the information presented was enough to show clear and convincing evidence that Dunn was actually innocent.

Sengheiser wrote in his ruling that “no juror, acting reasonably, would have voted to find Dunn guilty of these crimes beyond a reasonable doubt,” and ordered Dunn’s immediate release. Sengheiser directed the prison to release Dunn by 6 p.m. CDT Wednesday and threatened the prison warden with contempt if Dunn remained behind bars.

However, Republican Attorney General Andrew Bailey has opposed Dunn’s release for years. After Sengheiser’s ruling, Bailey filed a motion asking that Dunn be forced to stay in prison while he appeals the finding of actual innocence.
