An appeals court in Florida affirmed the dismissal of a defamation lawsuit filed by Michael Flynn against political strategist and Lincoln Project founder Rick Wilson, who accused the former national security adviser to Donald Trump of being a “Putin employee” as well as the leader of the conspiratorial QAnon movement.

The three-judge panel on the Second District Court of Appeals upheld a lower court’s ruling, which reasoned that Wilson’s comments were protected by the First Amendment.

Last year, Flynn filed a lawsuit seeking $50 million in damages from Wilson and a permanent injunction barring Wilson from continuing to defame him. Wilson sought and was subsequently granted a motion to dismiss the case by a trial court. Flynn then appealed the decision.

The appellate court’s Wednesday ruling came just one day after a federal judge in Florida tossed a different $50 million defamation lawsuit filed by Flynn which accused the federal government of maliciously prosecuting him for lying to the FBI about his contacts with agents of the Russian government. Flynn ultimately pleaded guilty to that crime and was later pardoned by Trump.
