A Colorado woman will serve three months in jail after admitting to having a sexual relationship with a 13-year-old boy and having his child.
Andrea Serrano, 31, of Fountain, was arrested in July 2022 on charges of sexual assault on a child by one in a position of trust and sexual assault on a child. In February, the charges against her were lowered to incest after she reached a plea deal with prosecutors.
The initial plea deal included 10 years to life of intensified supervised probation as a sex offender, enabling Serrano to avoid imprisonment.
The 13-year-old’s mother described Serrano as a “mother figure” to her son, emphasizing their long-standing relationship since his infancy. She also urged the judge to reconsider and give the defendant more time in prison for harming her son.
“She (Serrano) sexually assaulted my 13-year-old son … She introduced him to drugs, she needs to be in jail,” the mother of the victim said in court. “It’s a double standard. If she was a man, and my son was a girl she (Serrano) would be behind bars right now.”
Despite the prior plea agreement, an El Paso County judge sentenced her to 90 days in jail on Thursday, the Gazette reports. The boy’s mother urged the judge to incarcerate her, expressing concerns about setting a negative precedent and the lack of consequences.
“It sets a bad example for the community. There are no consequences,” she said. “This isn’t right. … She needs to go to jail.”

The court heard that Serrano had given birth to the child she conceived with the victim, and she currently has custody and is taking care of the baby.
Custody and visitation issues were mentioned during the hearing, but the judge said that would be handled by the Department of Human Services.
Serrano is currently free on bond and will remain free until her sentencing hearing. Check back for updates.
