Harvey Weinstein: Prosecutors Evaluating Additional Complaints Against Disgraced Mogul for Retrial

New York prosecutors said on Thursday that jailed producer Harvey Weinstein is facing a new indictment, after his conviction for sex crimes was overturned in April.

The New York Times reported that the indictment is sealed as Weinstein, 72, remains hospitalized and has not been arraigned. Prosecutors said they informed Weinstein’s attorney that they presented three new allegations of rape and sexual assault to a grand jury in mid-August.

Prosecutors said one of the incidents occurred at a residential building in Manhattan during the “winter season” of 2005 to 2006, while the third assault occurred in 2016.

Thursday’s hearing comes days after Weinstein, who remains jailed, underwent heart surgery.

In 2020, Weinstein was convicted in New York for raping one woman and trying to rape another. He was sentenced to 23 years in prison. In California, he was convicted of rape, forcible oral copulation, and sexual penetration by a foreign object and was sentenced to 16 years.

In April, an appellate court ruled that the court improperly allowed prosecutors to call several accusers as witnesses even though their claims did not result in criminal charges. In turn, the appellate court also overturned Weinstein’s 2020 conviction.

Weinstein’s second trial was tentatively scheduled for November. However, during Thursday’s hearing, the judge questioned whether it would start then considering Weinstein’s recent health issues, according to the New York Post.

Weinstein’s attorneys are expected to provide an update on his health at a September 18 court hearing.
