A new lawsuit has been filed in New Mexico against those involved in the fatal shooting of cinematographer Halyna Hutchinson the set of a western movie being filmed in that state in 2021.
Attorney Gloria Allred filed the lawsuit against 25 named individuals, including actor Alec Baldwin, armorer Hannah Gutierrez-Reed, and assistant director David Halls, and 100 “John Does” on behalf of Hutchins’ mother, father, older sister, and script supervisor Mamie Mitchell, KOAT reported.
Hutchins was shot and killed during a rehearsal for the “Rust” movie on October 21, 2021. Baldwin was handling the prop gun, which was handed to him by Halls, who declared it “cold” — safe to use, as CrimeOnline reported. The gun had been loaded with real bullets, however. A lengthy investigation never determined who loaded the tun.
Armorer Gutierrez-Reed, who was responsible for ensuring the safety of weapons used on the set, was convicted of involuntary manslaughter and sentenced to 18 months in prison earlier this year.
Baldwin is set to go on trial on the same charge in July. Halls pleaded no contest to a misdemeanor and got off with probation. He testified against Gutierrez-Reed and is expected to testify against Baldwin as well.
Allred filed a similar lawsuit earlier this year in California on behalf of the same people, according to Variety. That lawsuit followed a settlement announced in a lawsuit filed by Hutchins’ husband and son that had no involvement from Allred.
Hutchins’s parents,Olga Solovey and Anatolii Androsovych, and her sister, Svetlana Zemko, all live in Ukraine. Mitchell lives in New Mexico.
“We’re looking forward to litigating this case in New Mexico against all of the defendants that we allege in the complaint are responsible for causing villainous death, for causing Miss Mitchell’s injuries and for causing the loss of consortium damages of Halyna’s family, whom we represent and whose relationship with Halyna was severed so tragically,” Allred said.
“Loss of consortium” in most states applies only to spouses, but in New Mexico, it can apply to close family members.
The new lawsuit asks for unspecified damages.
