A New Orleans man is fighting for his life after he was ruthlessly beaten near the French Quarter because he accidentally stepped on another man’s shoe, according to police.

The man, identified by his family as Scott Wagner, was walking home from work at a local seafood restaurant when he went to a music club on Sept. 24. He left the club when he stepped on the man’s shoe as he was walking by, sparking the assault.

“The perpetrator turned around, approached the victim from behind and punched him one time, causing him to fall,” New Orleans Police said. “The perpetrator then punches the victim two more times from behind, causing the victim to lose consciousness.”

NOPD said the suspect, along with an accomplice, then walked away. Wagner has been in the hospital and has yet to regain consciousness, his family told local CBS affiliate WWL.

Wagner’s sister Gloria Cranmer said he suffered a traumatic brain injury.
