A majority of Americans believe that former President Donald Trump should face charges in two pending criminal investigations against him, a new poll exclusively shared with The Post on Wednesday shows.
The WPA Intelligence survey also found that if Trump is charged, his chances against President Biden in the general election would take a severe hit.
The poll of 1,571 registered voters found that 59% said they believe Trump should be criminally charged in Georgia where Fulton County District Attorney Fani Willis has been investigating the 76-year-old former president and his allies over allegations he engaged in a conspiracy to overturn the 2020 election results in the state.
In contrast, 41% said Trump should not be charged in the Georgia probe.
The survey found that 59% also said Trump should face charges in special counsel Jack Smith’s investigation into whether the ex-commander-in-chief mishandled classified documents, and refused to comply with a subpoena request from investigators seeking to obtain White House documents that he allegedly absconded with.
Again, 41% said Trump should not be charged in the federal probe.
Trump has already been indicted by a Manhattan grand jury on 34 felony counts of falsifying business records related to an alleged “catch and kill” scheme to suppress negative stories about him in the runup to the 2016 election and beyond.
Any additional criminal charges against Trump would negatively impact his campaign for the presidency, the poll found.
When presented with a 2024 general election ballot featuring Trump and Biden as the nominees, under the scenario that Trump has been charged in the Georgia probe, 49% said they would vote for Biden compared to 39% for Trump.

Similarly, 50% said they would vote for Biden versus 39% for Trump in a situation in which the former president has been charged in the Justice Department’s classified documents probe.
The poll found that Biden beats Trump by a narrower 7 percentage point margin – 47% to 40% – with no additional criminal charges being brought against the 45th president.
“Contrary to what one may hear on Truth Social, Trump’s indictment, in either the pending Georgia or federal cases, would energize Democrats, not Republicans, potentially producing the worst loss for a GOP presidential candidate in 60 years,” said WPA Principal Amanda Iovino. “In the process, Republicans would lose control of the House and forego pick-up opportunities in the Senate.”
The WPA Intelligence poll also found that an overwhelming majority of voters said they would not vote for a candidate in a down-ballot race in 2024 that echoes Trump’s claims that the 2020 election was “stolen.”
Only 37% of people surveyed said they would support a House or Senate candidate promoting the “stolen election” conspiracy theory versus 63% who said they would not vote for a person that denies the results of the 2020 election.
WPA Intelligence CEO Chris Wilson is an adviser to Never Back Down, a super PAC aligned with Florida Gov. Ron DeSantis’ expected bid for the presidency.
The polling firm said Wilson was not involved with the survey and the poll was not sponsored by Never Back Down or its associates.
The survey has a margin of error of 2.5 percentage points.
