BREAKING: DoJ Opens FAFO Probe Into Letitia James

Or did Democrats believe themselves immune to the precedents they set over the last four years?

Having knocked down all the trees of precedent and law to get to the ‘devil’ — or at least their conception of it — they now find themselves stunned to discover they have no cover when the devil has turned on them. Having run a politicized lawsuit against Donald Trump, and having campaigned on doing so, New York Attorney General now faces a criminal probe into civil-rights violations for abusing her office. And Donald Trump isn’t the only victim that the Department of Justice is investigating, either:





The U.S. attorney in Albany has issued two broad subpoenas to Attorney General Letitia James of New York, one related to her office’s civil fraud case that resulted in a half-billion dollar penalty against President Trump, according to three people with knowledge of the matter.

The second subpoena is related to another of the office’s long-running cases, against the National Rifle Association, the people said. …

Two people familiar with the matter said the new subpoenas are part of a civil rights investigation of the state attorney general office’s work, to determine if the office violated Mr. Trump’s rights, or others.

James has retained super-attorney Abbe Lowell, who immediately decried this as a “dangerous escalation.” He’s more right than he knows, although don’t expect him to admit it:

Ms. James’s personal lawyer, Abbe Lowell, on Friday called any investigation into Mr. Trump’s fraud case “the most blatant and desperate example of this administration carrying out the president’s political retribution campaign.”

“Weaponizing the Department of Justice to try to punish an elected official for doing her job is an attack on the rule of law and a dangerous escalation by this administration,” he said. “If prosecutors carry out this improper tactic and are genuinely interested in the truth, we are ready and waiting with facts and the law.”

Everything in that statement applies equally to James’ weaponized attempts to cripple Trump’s finances and keep him out of the 2024 presidential race. It also applies to Alvin Bragg’s equally corrupt prosecution in Manhattan on concocted felonies over ledger entries detailing non-disclosure agreement payments to Stormy Daniels. And it also applies to Fani Willis’ absurd RICO predicate in Georgia. Both Bragg and Willis had better expect subpoenas in the near future. 





Former special counsel Jack Smith — who pursued two prosecutions against Trump at the federal level — is also under investigation for his actions. That started as a referral from Sen. Tom Cotton (R-AR), alleging that Smith pursued prosecutions in violation of DoJ doctrine in order to interfere with an election:

The U.S. Office of Special Counsel confirmed Saturday that it has opened an investigation into former Special Counsel Jack Smith and whether he violated the Hatch Act through his criminal investigations into President Donald Trump.

The investigation follows a referral from Republican Sen. Tom Cotton of Arkansas earlier this week that asked the OSC to investigate Smith for his investigative and prosecutorial activities prior to the 2024 election which Cotton argued were intended to harm Trump’s political prospects. …

The OSC is an independent agency that is not empowered to investigate criminal matters – it is separate from the Special Counsel post that Smith formerly served in under the Justice Department.

OSC primarily operates as an agency to assist government whistleblowers in reporting allegations of waste or wrongdoing, and also enforces the Hatch Act which places restrictions of government employees from engaging in partisan political activities.

That’s true enough, but they can refer criminal matters to the DoJ if they uncover potential crimes, other than the Hatch Act, which is handled as a civil matter. And right now, the DoJ is open for business, baby.





Democrats have no one to blame but themselves. They spent the last four years abusing their power to conduct absurd lawfare campaigns against Trump and others, notably pro-life demonstrators (and the NRA!), all while claiming that “no one is above the law.” They labored under the delusion that these precedents would go unnoticed and unused, perhaps because they expected the American electorate to take these cases seriously and keep Democrats in power. Instead, voters saw right through them as corruptocrats determined to  — what did Lowell call it? — “carry out the president’s political retribution campaign.”

They enjoyed the spectacle when the president was Joe Biden and he declared open war on Trump and his supporters. James, Bragg, Willis, and Smith set those precedents for lawfare. They fooled around with abuses of power, and now they will find out exactly how it works on them.

One last point: the appellate courts in New York are taking their sweet time in reviewing the absurdly corrupt James and Bragg cases. If the DoJ does indict James and Bragg over this, it essentially makes the case into a federal review of both. If a federal court allows the prosecution to proceed, it would make a strong statement about the abusive and political nature of the lawfare of the past few years. It might also light a fire under the appellate courts in New York to finally admit the obvious and vacate these cases. 





Either way, this serves notice once again that Republicans plan to fight back against abuses of power. Maybe Democrats should really pay attention to this scene from A Man For All Seasons. They are about to be forced to stand upright against the windstorm they began.
